Terms of Service

Terms for the free use of the Nestro web and mobile applications by landlords, property managers and tenants. Version dated 31 October 2026.

1. Operator and scope of the Terms

Nestro is operated by AIVANNA s.r.o., company registration number (IČO) 23754885, with its registered office at Litobratřice č.p. 196, 671 78 Litobratřice, entered in the Commercial Register maintained by the Regional Court in Brno, Section C, File No. 147354 (the “Operator” or “we”). The contact email for contractual matters, support and complaints is support@nestro.cz. You may also send written correspondence to the registered office.

These Terms govern use of Nestro at nestro.cz and in the Nestro mobile applications (together, the “Service”). They apply to individuals and legal entities, landlords, property managers, workspace members, tenants and other users. If you use the Service on behalf of another person or organisation, you must be authorised to act on their behalf. An individual agreement with the Operator takes precedence to the extent that it differs from these Terms. This does not affect consumers’ statutory rights.

2. What Nestro provides

Nestro is a tool for managing property and related communications. Depending on your permissions and the features available, it allows you in particular to keep records of properties, contacts, tenancies, documents, charges and payments, manage tasks, inspections and requests, and communicate with other users. Your access also depends on what another user or workspace owner makes available to you. The web and mobile applications may offer different features.

Nestro does not provide real estate brokerage or legal, tax or accounting advice and is not a party to leases or disputes between users. A record in the application does not in itself establish property ownership, the existence of a debt or fulfilment of a legal obligation. Check documents, calculations, reminders and outputs against the underlying records and your circumstances. This does not limit the Operator’s statutory liability for its own Service.

3. Free use and technical requirements

Nestro is free to use. The Operator does not charge you for registering or using the Service. You pay for your own internet connection and devices. Payments of rent, advances, deposits or other obligations recorded in Nestro are made between the relevant parties and are not payment for Nestro.

The web application requires an internet connection, an up-to-date supported browser with JavaScript enabled, and technical storage necessary for signing in. Device and operating system requirements for the mobile application are listed in the relevant app store. Some features require permissions, such as permission to show notifications or to access selected files or photos. Denying a permission may limit the relevant feature, but does not in itself constitute consent to any other processing of data.

4. Registration and user account

Read these Terms before registering. The agreement for the free provision of the Service is concluded in Czech for an indefinite term when you create a user account after accepting the Terms. When registering by email, you confirm acceptance by ticking the relevant checkbox. When registering through an external account, follow the information displayed with that option. You can correct your details before submitting them. You may need to verify your email and complete registration to use protected features.

Provide accurate information, keep it up to date and use only an email address or external account you are authorised to use. Keep your password, signed-in devices and verification codes secure and do not share them with anyone else. To collaborate, use separate accounts and the available access permissions. If you suspect misuse of your access, contact us without undue delay and change your credentials where possible.

The current Terms are publicly available at nestro.cz/help/terms and can be saved using your browser. The agreement is not publicly accessible. Accepting these Terms does not constitute consent to receive marketing communications or to the processing of personal data for arbitrary purposes.

5. Workspaces, permissions and sharing

Manage personal and workspace content in accordance with your permissions. The workspace owner and authorised administrators may invite members, change permissions and manage workspace content within the features available in the application. Inviting someone to a workspace or sharing a property does not transfer property ownership or responsibility for managing it to the Operator.

Before sharing content, verify the recipient, their permissions and what you are sharing. Send a sharing link only to the intended recipients. Anyone who obtains the link may be able to access the content to the extent the link allows. Revoking access does not remove copies the recipient previously downloaded or otherwise retained with authorisation.

Conversations and certain profile or communications features are linked to the user account across workspaces. Switching workspaces therefore does not by itself separate conversations or their attachments. Always check the recipient before sending. Before transferring ownership of a workspace or deleting it, arrange for the handover of necessary materials and management rights.

6. Submitted content and personal data

You retain your rights in documents, photographs, messages and other content you submit. You grant the Operator permission only to store, technically process, display and make the content available to the extent necessary to provide the Service, deliver the features you select and apply your sharing settings. This permission does not transfer ownership of the content or grant general permission to use it for advertising.

Submit only content you are authorised to handle. This includes personal data of tenants, contacts and others, lease attachments and communications. You are responsible for having a lawful basis for your processing, meeting your obligations to inform the individuals concerned and configuring access correctly. Do not submit data you do not need for the purpose, particularly unnecessary copies of identity documents or sensitive information.

The Operator processes user account data to fulfil its own obligations in operating the Service. For personal data submitted to manage tenancies, the relevant landlord or property manager may be the controller and the Operator may be the processor. The specific roles depend on the purpose of processing. These Terms do not replace the information on personal data processing or the data processing agreement required under Article 28 of the GDPR. You may send questions and requests concerning personal data to support@nestro.cz. For data controlled by another user, you may also need to contact that controller.

7. Bank connections and payment records

Use bank connections and transaction imports only for accounts you are authorised to access. Connecting an account may require separate verification and authorisation with the bank or connection provider. The availability and scope of data retrieved depend on their terms, technical capabilities and how long the authorisation is valid. When it expires, you may need to reconnect the account.

When keeping payment records, Nestro does not hold your funds. Marking a payment, generating a QR code or matching a transaction does not initiate a transfer. You make the payment through your bank. Before confirming it, check the recipient’s account, the amount and other details. Regularly compare import results, automatic matches, balances and reminders with actual transactions and contractual records. A manual entry in Nestro is not proof of payment from your bank.

8. Automation, AI and external services

If you use an AI feature, such as importing data from a document, selected files or their contents may be sent to the technical providers needed to run that feature. Before using the feature, consider what data the source material contains. The output may contain errors or omissions. Verify it before saving or using it further. Automated output does not constitute a legal assessment of a document or a decision about someone else’s rights.

External sign-in, map data, message delivery, bank connections and app stores may have their own terms and technical limitations. Their separate services are governed by your relationship with the relevant provider. This does not relieve the Operator of responsibility for performance under your agreement, whether provided directly or through its suppliers.

Reminders, emails and notifications are supplementary features. They can be affected by device or mailbox settings, permissions or delivery outages. The legal effect of a message, request or notice depends on the law, the contract and the method of delivery. Using Nestro alone does not guarantee compliance with any requirements as to form or delivery. Check important deadlines and actions against the relevant records.

9. Rules of use and reporting objectionable content

  • Do not use the Service for unlawful conduct, fraud, impersonation, harassment, unsolicited bulk messaging or to violate the privacy or rights of others.

  • Do not upload malicious software or content you are not authorised to use. Do not bypass access permissions, security measures or technical restrictions on the Service.

  • Do not disrupt the availability of the Service or access anyone else’s data without authorisation. Obtain the Operator’s agreement in advance for automated access or security testing beyond the features expressly made available.

  • If you discover a bug or unauthorised access, send us a description at support@nestro.cz and do not further disclose other people’s data. Do not send us passwords or complete verification codes.

You can report objectionable content or conduct using the in-app reporting feature, where available, or by emailing support@nestro.cz. Tell us where the content is located, why you consider it objectionable and how we can contact you about the report. We will assess it and, depending on the circumstances, restrict or remove the content or take other proportionate action. You can challenge the action at the same email address.

10. Application licence

For the duration of the agreement, we grant you a free, non-exclusive right to use Nestro for its intended purpose through the interface made available to you. Rights in the application, its design, brand and source code remain with the Operator or the relevant rights holders. Without their permission, do not copy or sell the application or offer it as your own service. This does not affect rights that cannot be excluded by law or your rights in your own content.

11. Availability, updates and liability

We operate the Service with reasonable professional care and provide the updates necessary for it to function as agreed and remain secure. Maintenance, technical outages or limitations affecting particular features may occur. We address identified defects according to their nature and impact. We do not agree to uninterrupted availability or guarantee a specific response time. Statutory rights in respect of defective performance remain unaffected.

We may change features for security, changes in law, compatibility, changes to external interfaces or further development of the Service. We will give you advance notice of any material change. For a consumer covered by the rules for digital services, changes beyond necessary updates must not result in additional costs. If a change has more than a minor adverse impact, we will give you reasonable advance notice in text form of its nature and timing and of your right to terminate the agreement without penalty within 30 days of the notice or the change, whichever is later. Statutory exceptions continue to apply.

Liability for damage is governed by law. The Operator is not liable for inaccurate source material or unauthorised sharing attributable to a user to the extent that the Operator did not itself cause the damage by breaching an obligation. These Terms do not exclude or limit liability where the law prohibits it, particularly in cases of intentional conduct, gross negligence, harm to a person’s inherent rights or mandatory consumer rights. The fact that the Service is free does not in itself remove these rights.

12. Support and rights in respect of defects

For questions or complaints, contact support@nestro.cz or write to the registered office. Identify the account concerned, describe the problem and when it occurs, and provide contact details for our reply and the remedy you seek. Attach only the material needed to handle the matter. We will confirm receipt of the complaint, its contents and the remedy requested, then let you know the outcome or why the complaint was rejected.

If you have rights in respect of defective performance, you may require the defect to be remedied unless doing so would be impossible or disproportionately costly. For a digital service, we will remedy the defect within a reasonable time after it is reported and without significant inconvenience to you. If the defect is not remedied or recurs, or if the agreement is materially breached, you may terminate it subject to the statutory conditions. Other statutory rights and mandatory deadlines remain unaffected. For a free service, there is no right to a refund of a price you did not pay.

13. Ending use and deleting your account

You may terminate the agreement at any time without penalty by deleting your account in settings or notifying us at support@nestro.cz. To protect the account, we may take reasonable steps to verify your identity. Uninstalling the mobile application, signing out or leaving a workspace does not delete your account or by itself terminate the agreement. Ending use of Nestro does not change your leases or other obligations to third parties.

Before deleting your account, save the documents and data you still need and arrange for the handover of shared content management. After you confirm deletion, normal access is blocked and sessions are revoked. You may restore the account within the next 30 days using the available verification procedure. Once that period ends, the account is scheduled for permanent deletion. The period does not constitute a promise of a separate backup service.

Deleting an account may not remove every copy of an item of data. Other people may have their own documents or records, or the data may be subject to a legal retention obligation or needed to protect rights. We handle content and personal data in accordance with applicable legal obligations and the rights of those concerned. You can ask support to make your own content available before termination or, where the law provides, afterwards. Statutory rights to obtain content and personal data remain unaffected.

We may restrict access proportionately where necessary to protect security or the rights of others or to comply with a legal obligation. If a breach of the Terms can be remedied, we will generally ask you to remedy it first. In urgent cases we may act immediately. We will inform you of the reason and the available next steps unless the law or security considerations prevent us from doing so. We may terminate the agreement for a material or repeated breach. If we discontinue the Service in the ordinary course, we will give you at least 30 days’ notice and provide a reasonable opportunity to retrieve your own materials.

14. Consumers and dispute resolution

A consumer is an individual acting outside the scope of their business or independent professional activity. Registering with Nestro does not in itself make you a business operator. These Terms are interpreted so as not to limit rights guaranteed to you as a consumer by mandatory provisions of law.

As a consumer, you may withdraw from a distance contract within 14 days of its conclusion without giving a reason. Under these Terms, the Operator preserves this right even if you receive immediate access to the free Service. Send your notice of withdrawal within that period to support@nestro.cz or the registered office. No form is required, but you may use this template: “I give notice that I withdraw from the agreement for the provision of the Nestro Service concluded on [date]. First and last name: […]. Address: […]. Account email: […]. Date: […]. Signature (only if submitted on paper): […].” After 14 days, you may still end use of the Service without penalty under Section 13.

We will first try to resolve any dispute directly at support@nestro.cz. The Czech Trade Inspection Authority is the competent body for out-of-court resolution of consumer disputes within its statutory remit. Information and submissions are available at https://coi.gov.cz/informace-o-adr/. Subject to statutory conditions, you may file a request within one year of first asserting with the Operator the right at issue. Under its rules, the Authority’s alternative dispute resolution (ADR) procedure does not cover disputes arising from services provided entirely without payment. This does not affect the right to bring the matter before a court.

15. Changes to the Terms and final provisions

These Terms are governed by the law of the Czech Republic, particularly the Civil Code. This choice of law does not deprive a consumer of protection under the mandatory provisions of the law that would otherwise apply to their agreement. Disputes are decided by courts with jurisdiction under applicable law. These Terms do not establish exclusive jurisdiction to the detriment of a consumer.

We may amend the Terms to a reasonable extent to reflect changes in law, security, technical operation or the scope of the Service. We will notify you of the new version and its effective date in text form, generally by email, at least 30 days in advance. You may reject the change and terminate the agreement without penalty before it takes effect. Changes do not apply retroactively or reduce claims that have already arisen. Where the law requires fresh express consent, continued use alone does not replace it.

If any provision is invalid or ineffective, the remaining provisions continue in effect to the extent permitted by law. For newly concluded agreements, this version takes effect on 31 October 2026. It applies to earlier agreements only after it is duly incorporated into the contractual relationship. Publication of this article alone does not incorporate it.
